Terms and Conditions

Welcome to DEN Outdoors. By purchasing plans, products, or services from DEN Outdoors, Inc. (“DEN”, “we”, “our”, or “us”), you agree to the following Terms and Conditions.
These terms govern the purchase and use of DEN construction documents, prefab packages, and related services.
1. Digital Products
DEN construction documents and related project materials are delivered digitally.
Because digital products cannot be returned once delivered, all construction document purchases are final and non-refundable.
If you believe you were charged incorrectly or experienced a duplicate transaction, please contact our team and we will review the issue.
2. Plan License
Purchasing DEN construction documents provides a license to build the design, not ownership of the design itself.
DEN Outdoors retains full ownership of all design work and intellectual property.
A standard purchase grants the right to construct one (1) residential structure based on the purchased design unless otherwise stated.
If additional structures are planned, additional licenses or a separate development agreement may be required.
3. Permitted Use
Customers may:
- build one residential structure from the purchased construction documents
- make reasonable modifications necessary for construction
- hire licensed professionals to review and adapt the documents for site-specific requirements
Modifications made for construction purposes do not transfer ownership of the design.
The underlying design remains the intellectual property of DEN Outdoors.
4. Prohibited Use
The following uses are not permitted without written authorization from DEN Outdoors:
- constructing multiple homes from a single construction document purchase
- reselling or redistributing the documents
- using the design as the basis for a new commercial plan offering
- marketing modified versions of DEN designs as original work
- sharing or distributing the documents to third parties for reuse
Unauthorized use may constitute copyright infringement.
5. Design Protection and Derivative Works
All DEN designs are protected by copyright and intellectual property law.
Purchasing construction documents grants a license to construct the design but does not transfer ownership of the design itself.
Builders, designers, engineers, and other professionals may modify documents as needed to complete a permitted construction project. However, those modifications do not transfer ownership of the underlying design.
If a project is derived substantially from a DEN design, it is still considered a DEN design.
Creating modified versions of DEN designs for resale or commercial use without authorization is prohibited.
6. Manufacturing and Fabrication Rights
DEN designs may not be used to manufacture building systems or construction products without written authorization from DEN Outdoors.
This includes but is not limited to:
- prefab homes
- modular homes
- panelized building systems
- structural kits
- building packages
- off-site manufactured assemblies
Builders and contractors may fabricate components necessary to construct a single permitted project, but may not manufacture or distribute construction systems derived from DEN designs as a product or service.
The right to produce prefab or manufactured building systems based on DEN designs is reserved exclusively for DEN Outdoors and its authorized partners.
7. Development and Commercial Projects
Construction documents purchased through the DEN website are intended for individual residential construction.
Projects involving multiple homes, hospitality developments, or commercial real estate projects require a separate development license from DEN Outdoors.
Customers planning multiple builds should contact our team to discuss appropriate licensing.
8. Attribution
If DEN designs are featured publicly, including in press, social media, marketing materials, or property listings, the project should be credited as a DEN Outdoors design.
9. Construction Responsibility
DEN Outdoors provides construction documents and design services only.
Customers are responsible for:
- hiring licensed engineers, contractors, and other qualified professionals
- verifying compliance with local building codes
- obtaining permits and approvals
- ensuring safe construction practices
Documents may require modifications to meet local code requirements or site conditions.
10. Limitation of Liability
To the fullest extent permitted by law, DEN Outdoors is not responsible for construction costs, delays, defects, or damages arising from the use of its construction documents.
The maximum liability of DEN Outdoors for any claim relating to a purchase shall not exceed the amount paid for the product or service.
11. Customer Responsibility and Indemnification
By purchasing DEN products or services, customers agree to hold DEN Outdoors harmless from claims arising from construction, site conditions, or project execution.
Customers agree to work with qualified professionals to ensure proper implementation of the construction documents.
12. Prefab Package Deposits
Purchasing a DEN Prefab Package deposit secures your place in the DEN prefab pipeline and initiates pre-construction services with our team.
These services include early coordination, project feasibility discussions, scheduling within the fabrication pipeline, and preparation for the manufacturing phase of the project.
Deposit Purpose
Prefab deposits are made to:
- initiate pre-construction services
- reserve a fabrication slot within the DEN manufacturing pipeline
Because manufacturing capacity is limited, deposits are used to allocate internal resources and fabrication availability.
Refund Window
Prefab deposits are refundable for 14 days from the date the deposit is made.
After the 14-day period, deposits become non-refundable, as project coordination and pipeline allocation will have begun.
Price Lock
The prefab deposit locks the displayed price for the selected model for 12 months from the date the deposit is placed.
After the 12-month period, DEN Outdoors reserves the right to update pricing to reflect current material costs, labor conditions, manufacturing changes, or updated product pricing.
At that time:
- the customer may accept the revised pricing and continue with the project
- or DEN Outdoors may elect to terminate the relationship if the project is no longer viable under updated pricing conditions
Non-Refundable Circumstances
After the 14-day refund window has passed, deposits are not refundable, including situations where:
- financing cannot be secured
- the project exceeds the customer’s construction budget
- a builder cannot be found
- permits or approvals are denied
- zoning restrictions prevent construction
- site conditions prevent construction
- the customer chooses not to proceed
These risks are part of the normal homebuilding process and remain the responsibility of the customer.
Manufacturing Contract
During the normal lifecycle of a prefab project, customers will receive a separate manufacturing agreement once the project advances toward fabrication.
This agreement will define:
- final project scope
- fabrication specifications
- manufacturing payment schedule
- delivery coordination
- responsibilities between DEN, the customer, and the builder
The manufacturing agreement will also reflect the complete financial structure of the project, including all deposits received, applicable deductions, customization fees, add-on services, material selections, applicable taxes, and any other project-related charges .
The terms of the manufacturing agreement will govern the fabrication and delivery of the prefab structure and may supersede portions of this policy where applicable.
13. License Termination
DEN Outdoors reserves the right to terminate licenses if these terms are violated.
Termination does not limit DEN’s right to pursue remedies available under copyright law.
14. Governing Law
These Terms and Conditions are governed by the laws of the State of New York.
Any disputes relating to these terms will be handled within the jurisdiction of New York courts.
15. Updates to Terms
DEN Outdoors reserves the right to update these Terms and Conditions periodically.
Continued use of DEN products or services constitutes acceptance of the updated terms.
